Writing a motion I'm in a divorce case and my property is losing value at a rapid girl want x dating , and is approaching foreclosure. The OP doesn't care (but wants most of the money out of it). I am delinquent on payments now. I would like to file a motion to get the property out of the downward spiral by asking the judge to decide on it before the girl want x dating co takes it. The OP asked for an obnoxious majority of proceeds. Considering the other facets to the case, this is very unfair. And I don't want to lose the property. What shoudl I do, scribble scrabble the demands out on a piece of paper and file it with the court to ask for a hearing? I tried to get an atty for assistance on the matter, but none were interested. I guess they all want to be retained.

    Sell it... ...and have any proceeds from the sale put into an escrow account until the division of the proceeds has been determined by a judge. You don't have to wait for a hearing to sell the property if you're that close to foreclosure. Of course, those proceeds will be tied up until the matter is decided and could impact your ability to afford new living arrangements. You also don't have to have an agreement as to the split before you sell, but do have to agree to have it held in escrow until decided.

    Not a choice I'd rather it foreclose if I can't get the judge to make a decision before foreclosure. I want to keep this property so I can make something out of it. It has an enormous amount of potential. Otherwise, I'd just as soon girl want x plus dating it so the fight can be over.

    Wrong I just don't want to waste anymore time on it. I have to work and support the kiddos. It takes so much time. I'd rather just be done with it. If the judge rules against me, it's going away and I'm getting on with my life. If the property didn't have so much potential value, I'd girl want a foreign affair it right now.
